DOL oversees 26 boards of registration, licensing and regulating more than 500,000 individuals and businesses across 100 trades and professions. DOL also licenses and regulates the Office of Public Safety and Inspections (OPSI) and the Office of Private Occupational Schools. The mission is to protect public health, safety and welfare by licensing qualified individuals and businesses and enforcing licensing laws and regulations. The Division values an inclusive, diverse, and respectful work culture and aims to reflect diversity across all levels of the agency.About the RoleThe Counsel II provides legal support and advice to assigned boards, divisions, units, and/or offices within the Division of Occupational Licensure, as well as the Office of Private Occupational School Education and the Office of Public Safety and Inspections. Assignments may vary based on business and/or operational needs.Duties and Responsibilities Attend board meetings and other meetings related to assigned boards, divisions, offices, and/or units, and provide legal support and advice on matters before them. Matters may include legal issues related to regulated occupations, open meeting law, public records law, state ethics law, agency policies and procedures, and court decisions affecting agency operations. Advise on the process governing promulgation of regulations under G.L. c 30A, associated regulations, and other requirements. This includes drafting regulations, advising on legal matters, presenting regulations for review and approval, drafting regulations and forms, coordinating public hearings, modifying regulations based on public input, and filing final regulations with the Secretary of State’s Office. Review, analyze, and summarize legislation relevant to assigned boards, divisions, offices, and/or units. Draft proposed legislation and prepare memoranda for Agency review or legislative committees. Advise on disciplinary matters before the body and the conduct of 30A adjudicatory hearings, including review of pending cases, investigative conferences, orders to show cause, settlement terms, hearings, and post-hearing dispositions. Consult with other legal counsel and Agency officials regarding appeals of decisions by assigned boards, divisions, offices, and/or units; act as the Agency contact with the Office of the Attorney General and update the Outside Litigation Report. Provide legal support and advice regarding negotiation and drafting of contracts and related documents for assigned boards, divisions, offices and/or units. Identify opportunities for improving Agency processes, work product, and outreach. Collaborate on project teams to improve processes, write regulations, design implementation of new laws, and conduct training as appropriate. Maintain a bank of forms and a reference system of unpublished legal decisions related to the boards, divisions, offices, and/or units. Act as a liaison with representatives of other governmental agencies and the private sector to identify and resolve problems of common concern (e.g., human trafficking, carbon monoxide incidents, insurance fraud). Provide other legal advice and administrative assistance as needed or assigned. Preferred Knowledge, Skills, and Abilities Experience in litigation and/or administrative hearing processes. Experience in legal research, legal writing, and participation in civil procedures and processes. Strong interpersonal and organizational skills. Experience working on legal issues in trades and professions overseen by the Agency.
