OverviewThe position will serve as the Chief Legal Counsel to the Office of Medical Marijuana Use. The incumbent will function as lead attorney for the Office and will be responsible for supervising other programmatic attorneys. The incumbent will coordinate Office legal needs with other attorneys and staff to ensure client satisfaction. This position will provide the Office with clear and consistent advice and counsel on general administrative matters, statutory, and regulatory interpretations. The incumbent will engage in rulemaking, including drafting and promulgating administrative rules pursuant to Chapter 120, Florida Statutes, on complex subject matters. This position is responsible for reviewing and responding to administrative filings including petitions for variance, waiver, and declaratory statements. The position will be responsible for reviewing and preparing agency action in disciplinary proceedings against licensees and handling resulting administrative litigation. The incumbent will provide oversight of and/or representation in the Office's litigation, including formal and informal administrative hearings, state and federal court actions, and appeals. The incumbent provides expert legislative analyses and legal review of all bills impacting the Office. Additionally, the position provides counsel on implementing legislation. The incumbent provides the Office with guidance on public records issues and assists with review as needed. The position is responsible for planning and directing the work of the Office's attorneys, approving leave, documenting performance deficiencies, recognizing milestones and successes, and recommending hiring or disciplinary action. The position performs other related duties as required by the Deputy General Counsel or the General Counsel.Required Knowledge, Skills, and AbilitiesProfessional experience in the practice of law, legal research, teaching law, or in administrative hearings or court proceedings. Knowledge of Microsoft Office software, knowledge of rulemaking authority and process; knowledge of civil and administrative proceedings and procedures; ability to communicate effectively verbally and in writing.QualificationsLaw degree (J.D.) and five years of professional experience in the practice of law.
