A minimum of four (4) years of experience in data privacy and cybersecurity is required. Candidate should be a subject matter expert in consumer data privacy laws and regulations, cybersecurity laws and regulations, data breach laws, contract drafting and negotiations including privacy and data security language, and vendor/client contracts. Experience with AI laws, regulations, and contract drafting and negotiations is a plus.**Position Description**The Associate Counsel will work directly under the direction of the Privacy Counsel in support of a broad range of responsibilities including, but not limited to:* Serve as key member of the Voya Privacy Office, which provides centralized resources for the company’s management and oversight of data privacy, cybersecurity, and AI compliance and risk management* Provide advice/counsel across business lines relating to the organization’s legal rights and obligations under CCPA/CPRA, GLBA, HIPPA, and other relevant data privacy regulations* Draft, review, and negotiate client and vendor agreements, focusing on data privacy, cybersecurity, AI obligations and requirements, privacy and data security addenda, data protection agreements, and business associate agreements* Collaborate with, and provide legal support to, the IT and cybersecurity teams, strategic sourcing, IT and operational risk, and vendor management.* Identify, evaluate, and address issues of legal risk. Research, analyze, and interpret proposed and existing laws, statutes, and regulations* Structure, draft, negotiate and/or approve various legal contracts, policies and other documents related to a variety of data privacy, data security, cybersecurity, AI, and operational matters* Play a significant role in providing practical, legal, and business advice to the company’s stakeholders on legal and strategic matters* Work closely with internal departments to ensure the company’s interests are covered during agreement negotiations* Partner with business development and client onboarding teams to respond to privacy, data security, AI inquiries, and data privacy questionnaires from customers* Effectively communicate regulatory and procedural changes and important issues to affected stakeholders and business units* Work on other issues as required**Education and Experience*** Have earned a Juris Doctor from an accredited law school* Be a current and active member in good-standing of a U.S. state and/or federal Bar Association* Have been a practicing lawyer for at least four (4) years, with an emphasis on data privacy, cybersecurity, and AI* Be well-versed in data privacy under CCPA/CPRA, GLBA, HIPAA, and other applicable and evolving regulations* Have experience drafting data privacy policies and procedures* Certification by the International Association of Privacy Professionals, such as CIPP/US and CIPP/EU, preferred* Prior in-house experience preferred**Knowledge, Skill, and Ability*** Possess excellent legal contracting skills, including the ability to draft, negotiate, and interpret* Possess excellent oral and written communications skills, including the demonstrated ability to prepare and orally deliver excellent, detailed, concise and effective memoranda, briefings, slides and other decision materials to executive staff and company personnel* Have a demonstrated ability to manage multiple, complex issues simultaneously* Demonstrate a commitment to a collegial work ethic, including mentoring, collaboration, and working well with a large number of stakeholders* Pragmatic, business focused approach, with an ability to balance business goals and commercial realities with legal risks#LI-KD1****Compensation Pay Disclosure:****Voya is committed to pay that’s fair and equitable, which means comparable pay for comparable roles and responsibilities.The below annual base salary range reflects the expected hiring range(s) for this position in the location(s) listed. In addition to base salary, Voya offers incentive opportunities (i.e., annual cash incentives, sales incentives, and/or long-term incentives) based on the role to reward the achievement of annual performance objectives. Please note that this salary information is solely for candidates hired to perform work within one of these locations, and refers to the amount Voya Financial is willing to pay at the time of this posting.Actual compensation offered may vary from the posted salary range based upon the candidate’s geographic location, work experience, education, licensure requirements and/or skill level and will be finalized at the time of offer.
