5 days ago Be among the first 25 applicantsOverviewServes as the primary legal advisor to the EAA Board of Directors and EAA Executive Management. Advises and serves as agency resource on legal matters including administrative issues, transactional contracts, public finance, regulatory compliance, real estate, open records and open meetings, employment law, and EAA policies and procedures. Provides legal advice, counsel and assistance to the EAA and its Board of Directors. Performs analysis of complex factual and legal issues and prepares briefs and general counsel opinions on relevant matters. Represents the EAA in litigation matters or administrative procedures and hearings. Drafts, reviews, and revises agreements, contracts, and other legal documents relating to the operations of the EAA in the carrying out of its statutory mission in compliance with all applicable laws, policies and procedures. Stays abreast of statutes, court opinions, regulations and other laws affecting EAA operations and administration. Manages, facilitates, and directs the work of outside counsel at the direction of the EAA Board of Directors, the General Manager and/or the authorized designee. Interprets federal and state laws as they apply to the EAA, responsibilities and limitations of the EAA as a political subdivision of the State of Texas and a regulatory groundwater management agency. Researches, analyzes, and prepares legal memoranda, opinions and training bulletins on relevant local, state and federal laws and legislative updates as necessitated by changes in the law or as requested by the EAA General Manager or EAA Board of Directors. Manages the public election process for the EAA Board of Directors. Prepares and presents periodic information and reports for executive staff and for meetings of the board of directors and its committees. Assists with interactions, mediations, and negotiations with state and federal officials, private entities, and customer representatives concerning EAA operations, attends public meetings of the EAA Board of Directors, EAA Committee meetings and advises and addresses members in executive sessions or makes public presentations. Compiles data, statistics or other information related to legal work for reports. Works collaboratively with others. Maintains good standing as a member of the State Bar of Texas and remains current in all continuing legal education requirements. QualificationsA Juris Doctorate from an accredited law school. License to practice law in the State of Texas. Must be in good standing with the Texas State Bar. A minimum of eight years’ experience as a licensed, practicing attorney with proficient knowledge of legal principles, practices, and proceedings, including knowledge of pertinent federal, state, and local laws, statutes and regulations as they may pertain to EAA operations and local governmental entities.Experience in environmental and administrative law, public law and public law finance issues, complex real estate and business transactions, water law, contract law, labor and employment related matters, or related fields. Experience in the following specific areas of law are preferred: Texas surface water and groundwater rights, including the regulation of such rights; Texas Administrative Procedure; Texas Public Information Act; Texas Open Meetings Act; Texas Election Law, and the requirements for procurement of goods and services by Texas Local Governmental entities. Experience working with an elected board of directors a plus.Strong interpersonal and problem-solving skills. Effective oral, written, and analytical skills. Valid driver’s license and ability to operate a motor vehicle. Work Environment and ScheduleJob performance may require listening, seeing, sitting, talking; occasional reaching, grasping, lifting, handling, pulling or pushing, balancing and carrying of items such as boxes of materials, books, etc. with weights not exceeding 25 pounds; limited walking, standing, stooping, and bending; some irregular hours and long workdays and moderate levels of stress.
