FULL JOB DESCRIPTION In an investigative team environment, and generally under minimal supervision, conducts intake, prescreening, and screening investigations for Bar Counsel pursuant to Supreme Court Rules. Prepares detailed investigative reports and testifies at disciplinary hearings in defense of investigations. Conducts other investigations, as requested by the applicable internal staff or external third party. Duties and Responsibilities The duties and responsibilities listed below are essential to the employee's position. Conducts thorough investigations using investigative tools, resources and techniques to collect evidence for intake, pre-screening, screening, formal prosecution of disciplinary cases and UPL matters, as well as reinstatement applications. Conducts file review, surveillance, and investigation to locate and interview witnesses, complainants and respondents. Prepares detailed investigative reports. Serves subpoenas and other court documents. Furnishes oral and written affidavits and depositions. Obtains affidavits and signed statements from witnesses, complainants and respondents. Creates and maintains investigative files and case logs, electronically and/or hard copy. Translates letters, legal documents, audio/video recordings, or other material; and/or translates spoken passages during phone calls, interviews, or meetings from one language to another as necessary. Expresses either approximate or exact translation, depending upon Bar Counsel's request. Interacts with courts and their personnel, including administrators and judges and various governmental agencies at the local, state, and federal levels. Accesses investigative databases in accordance with user agreements and maintains confidentiality of information gathered. Appears and testifies before the Presiding Disciplinary Judge in disciplinary, disability or reinstatement hearings. Performs other jurisdictional investigations as requested. Performs all other related duties, as assigned. Requirements Education and/or Experience Required Bachelor's degree required, preferably in the field of criminal justice, law, accounting, or related major. Three (3) to five (5) years of field investigations preferably with a state or federal regulatory agency. Fluent in written/oral Spanish is beneficial but not required. Skills and Abilities Performs all duties in compliance with internal procedures and external regulations. Is responsible for bringing compliance issues to the attention of management. Ability to read and comprehend instructions, correspondence, memos, legal documents, legal language, and the court legal process. Ability to write routine and non-routine reports and correspondence. Ability to conform writing to prescribed style format. Excellent verbal and written skills. Strong analytical and creative ability is required. Knowledge of Rules of Professional Conduct. Must have high level of interpersonal skills to handle and maintain highly sensitive and confidential information gathered or learned. Position requires demonstrated poise, tact and diplomacy in adverse situations. Strong attention to detail and well organized. Must be team oriented but able to work independently. Ability to work on multiple projects and to make decisions in accordance with established policies, procedures and deadlines. Strong time management skills. Ability to recognize and refer legal questions to appropriate Bar Counsel. Ability to use good judgment and make quick, rational, and logical decisions in a fast paced field investigation environment. Computer Skills Microsoft windows environment with Office Suite to include formatting and production of documents. Proficient in Microsoft Word and Excel and prefer knowledge of eProsecutor software application. Ability to access and proficiently use various local and national investigative databases, Internet search engines/websites including legal and government repositories and other research tools when having limited information. Certificates, Licenses, Registrations: Required: Position may require travel within metropolitan area; thus, reliable transportation is required. If using personal vehicle, must have appropriate driver's license and insurance coverage. Other Regular attendance is required and must be able to travel state-wide on short notice. Weekends and evenings may be required on an occasional basis to fulfill duties of position. Individual must be able to work in a fast-paced environment with ability to handle and prioritize multiple, competing tasks and demands and to seek supervisory assistance as appropriate.
