Yes County Albany Street Address 1220 Washington Ave. City Albany State NY Zip Code 12226 Duties Description Reporting to the General Counsel, the Deputy Counsel for the Cannabis Control Board (CCB) will serve in the Office of Cannabis Management's (OCM) Office of General Counsel (OGC) and will work directly with the CCB. The Deputy Counsel will assist the General Counsel in providing the CCB with legal guidance and legal advice on all matters that come before the CCB. The Deputy Counsel will serve as a representative of the CCBu2019s interests within the OCM and OGC. The Deputy Counsel will manage the administrative appeals submitted to the CCB and other matters that require written opinions from the CCB. The Deputy Counsel will lead the development of standard operating procedures and internal management of appeals and other written opinions from the CCB. The Deputy Counsel will assist with the preparation and review of monthly meeting packets for the CCB. The Deputy Counsel may also be requested to assist with litigation matters in State or Federal courts in which OCM and/or the CCB are named as parties.The following outlines the duties of the Cannabis Control Board Counsel, who will serve in a deputy counsel role within the Office of the General Counsel. u2022 Serve as a Representative of the Cannabis Control Board (CCB) and the CCBu2019s interests within the Office of the General Counsel.u2022 Assist the General Counsel in providing the CCB the legal guidance and legal advice necessary for the execution of its duties under the Cannabis Law and on all matters that come before the CCB.u2022 Participate in meetings with the Governoru2019s Counselu2019s office and the Office of General Counsel to provide CCB perspective and assist the General Counsel to ensure the interests of the board are considered in deliberations.u2022 Participate in weekly meetings with the Office of General Counsel. u2022 Assist the General Counsel with the development of standard operating procedures for matters that require a final determination by the CCB.u2022 Prepare recommended written decisions, including but not limited to decisions on appeal from administrative hearings and decisions for granting a license as promoting a public convenience and advantage.u2022 Assist with the review and drafting of advisory opinions for unreasonable and impracticable claims against municipalities. Provide CCB feedback to the General Counsel on final draft. u2022 Be present at settlement negotiation discussions regarding litigation and, under the direction of the General Counsel, discuss settlement options with the CCB members if a question or concern is raised.u2022 Attend CCB meetings to assist the General Counsel in providing legal counsel as needed and take minutes during executive session. u2022 After meetings, distribute the written decisions voted upon by the CCB and record other actions and votes taken.u2022 Participate in CCB meetings with agency teams as needed, including board prep sessions, briefing sessions, and other ad hoc meetings. u2022 Assist with litigation in which the CCB and/or the Office are named as defendants, including assisting the General Counsel in providing legal counsel and litigation strategies.u2022 Review and assist with drafting correspondence sent in the CCBu2019s name by the office, such as Municipality Opinions responses.u2022 Review materials prepared by the Office in advance of CCB meetings, including all resolutions and proposed regulations.u2022 Assist the CCB with the review of information submitted in preparation of board meetings and conduct follow-up for additional information as needed.u2022 In consultation with the General Counsel, flag concerns or related matters that may impact future CCB actions.u2022 Under the supervision of the General Counsel, research, prepare legal memoranda, and other additional information as requested by the CCB on a case-by-case basis.u2022 Supervise one or more attorneys assigned to assist with reviewing and/or drafting recommended decisions, drafting correspondence sent on behalf of the CCB, and preparation of meeting material and other legal memoranda.u2022 Assist the CCB secretary, maintaining an up-to-date document library accessible to the CCB including materials relating to matters pending a final determination, and prior CCB determinations.u2022 Assist the CCB secretary with orientation for new CCB Members providing materials for review regarding the Cannabis Law and the regulations and other resource material. Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.NOTE: IN ORDER TO AWARD THE PROPER CREDIT FOR WORK EXPERIENCE, RESUMES MUST INCLUDE MONTH AND YEAR FOR START AND END DATES. IF ANY OF THIS EXPERIENCE IS LESS THAN FULL TIME YOU MUST INDICATE THE AVERAGE NUMBER OF HOURS WORKED PER WEEK.
