Job Description

The Securities Commissioner serves as the executive director of the Texas State Securities Board (the Agency) and is responsible for the administration and enforcement of the Texas Securities Act (the Act). The Securities Commissioner directs all activities of the Agency, implements the policies of the Agency's governing Board, and ensures that the provisions of the Act are at all times obeyed. The Securities Commissioner is appointed by the Board and serves at the pleasure of the Board. Specific duties include: Ensuring that investigations are initiated to prevent or detect violations of the Act and that evidence of violations is promptly referred for criminal, civil, or administrative enforcement action; overseeing the administrative, law enforcement, inspections, securities registration, dealer registration and investment adviser registration functions of the Agency; Supervising the activities of a highly-specialized staff of attorneys, accountants, financial examiners, and support personnel; Serving as the Agency's representative to the North American Securities Administrators Association; Supervising the submission of legislative appropriations requests and compliance with state reporting requirements; and Representing the Agency in presentations made to state and federal regulators, securities industry groups, consumer organizations, and Texas legislature as necessary.This position will require work to be performed primarily in person at the Agency's Austin office.MINIMUM QUALIFICATIONSJ.D. degree from an accredited law school. Graduation from an accredited 4-year college or university. At least 3 years' experience with securities-related matters or 5 years of senior supervisory experience within a state or federal agency or private sector management experience in the securities industry. Experience in public speaking and presentation skills including the ability to effectively represent the Agency in presentations to state and federal regulators, securities industry groups, consumer organizations, and at legislative hearings.PREFERRED QUALIFICATIONSSubstantial knowledge and understanding of the Texas Securities Act and rules adopted by the State Securities Board. Substantial experience managing professional and support personnel and supervising the operations of a professional office environment.Ability to evaluate legal and factual issues to determine whether administrative subpoenas or administrative orders should be issued or referrals for civil or criminal action should be made.
