Yes County Albany Street Address 3 Empire State Plaza City Albany, NY State NY Zip Code 12223 Duties Description The Director of the Office of Hearings and Alternative Dispute Resolution (OHADR) reports directly to the Executive Deputy of the Department of Public Service and will be responsible for duties including, but not limited to: u2022 Attracting, developing, directing, motivating, and driving performance from the Hearing Examiners and support staff employed by OHADR.u2022 Applying first-class interpersonal and communication skills and working collaboratively with Department Directors and Executive Staff.u2022 Supporting the development of a leadership culture focused on the highest quality decision-making on the most effective accomplishment of objectives.u2022 Basing decision-making on ethics and integrity.u2022 Planning, organizing, directing, and coordinating the work of the Hearing Examiners, which includes, but is not limited to: handling all proceedings in which hearings and other cases and disputes are held; overseeing the development of official case records; analyzing arguments and evidence offered by parties; drafting rulings and notices; offering advice and recommendations about how issues should be resolved by the New York State Public Service Commission (Commission), the New York State Board on Generation Siting and the Environment (Siting Board), and Office of Renewable Energy Siting and Electric Transmission (ORES); drafting Commission, Siting Board and ORES permit decisions; gathering input from the general public; and, participating in a broad range of cases or other disputes in which Alternative Dispute Resolution techniques may be employed.u2022 Serving as an advisor and consultant to the Chair, the Commission, the Siting Board and ORES regarding legal, procedural, and policy matters related to the regulation of gas, water, electric, steam, cable, and telephone utilities, the siting of gas and electric transmission lines, and the siting of wind, solar, and fossil fuel generation facilities.u2022 Attending Commission and Siting Board meetings in order to advise and make recommendations.u2022 Overseeing the preparation of correspondence, rulings, notices, rules and regulations, Commission and Siting Board orders, and ORES permit approvals, ensuring compliance with law and State and Agency policy.u2022 As necessary, directly serving as, or carrying out, the responsibilities of a Hearing Examiner for all or part of a proceeding.u2022 Fielding inquiries from elected officials, the general public, and parties to a proceeding regarding procedural issues.u2022 Coordinating the work of OHADR with other offices in determining processes and strategies for the development of issues, a record for decisions, and in developing consensus recommendations for the Commission, Siting Board and ORES.u2022 Analyzing proposed legislation and formulating recommendations in areas that affect the Commissionu2019s rules, regulations, and responsibilities.u2022 Developing or revising Commission, Siting Board and ORES rules and regulations as necessary to implement the Departmentu2019s statutory responsibilities.u2022 Advising on, and assisting in, implementation of the official operations of the Department, including but not limited to processes and procedures for filing, issuance, and retention of official documents and for handling of confidential documents, in coordination with the Office of the Secretary, Central Operations, and Office of General Counsel.u2022 Providing advice and support to the administrative offices of the Department, particularly with regard to the implementation and oversight of contracts for court reporting services and provision of intervenor funding in siting cases and the development of that portion of the Departmentu2019s budget attributable to intervenor funding; and serving as liaison with key administrative/oversight and other State agencies. Minimum Qualifications Law degree, current member in good standing of the New York State Bar, and nine years of post-bar, progressively responsible experience as an attorney in any combination of the following:u2022 In a governmental regulatory agency as an: Administrative Law Judge, Attorney, Hearing Officer or official with policy responsibilities.u2022 As an attorney litigating and/or negotiating matters in governmental regulatory proceedings and/or court proceedings involving complex technical facts or policies.u2022 As a judge or judicial clerk or in a similar adjudicative capacity.u2022 As a legislator, legislative staff, lobbyist, or similar position requiring analysis of laws or regulations.u2022 As a mediator or arbitrator in cases involving complex financial and technical issues. Preferred candidates will have experience in a managerial or leadership capacity. The primary location for this position is Albany, NY with at least 10% travel which requires possession of a valid driveru2019s license. This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority.
