Office Location:95 4th St Suite 3, Chelsea, MA 02150 PURPOSE OF THE JOB To enforce or cause to be enforced the penalties provided by law against every person who is guilty of a violation of chapter 138 or commission regulations of which they can obtain reasonable proof and make all needful and appropriate investigations for that purpose pursuant to MGL Chapter 10 u00a772, and to perform related work as required. ESSENTIAL FUNCTIONS AND RESPONSIBILITIES The enforcement of the Liquor Control Act (MGL Ch. 138), Commission Regulations (204CMR) and related laws of the commonwealth. The investigation of licensed premises engaged in the manufacture, sale, transportation, exportation, importation, keeping or storage of alcoholic beverages to determine compliance with governing laws, rules and regulations. The investigation of the unlawful manufacture, sale, transportation, exportation, importation, keeping or storage of alcoholic beverages. Collection of relevant information and evidence through, but not limited to, observations, surveillance, electronic intelligence databases, administrative searches and interviewing suspects and witnesses. The development of investigative case files and databases. The writing of reports and affidavits relative the findings of investigations. The reporting and presentation of investigation results to the Chief Investigator. The prosecution of alleged violation of laws and regulations before the commission. The filing of criminal complaints and affidavits, as well as presenting testimony, in the district courts of the commonwealth. The enforcement of the Liquor Control Act at large sports and concert venues throughout the commonwealth. The execution of powers of arrest to enforce the penalties provided against any person or entity, both in and outside the legal liquor industry, who violate the Liquor Control Act. The Coordination of joint investigations with local, state and federal law enforcement officials. The investigation of assigned license applications consisting of; but not limited to, new licenses, license transfers, manager changes, license pledges, change of licensed location, alteration of licensed premises. OTHER DUTIES AND RESPONSIBILITIES To develop and maintain communications with municipal, state and federal law enforcement agencies. To develop and maintain communications with the Office of the Attorney General, the Department of Public Safety, the Registry of Motor Vehicles, the Department of Public Health and regional community coalitions. To present training classes in the enforcement of the Liquor Control Act to municipal, state and federal law enforcement agencies. To present training in the proper filing of license applications to municipal licensing authorities and licensees. To coordinate and manage Division administrative matters as directed by the Chief Investigator. KNOWLEDGE AND SKILLS The ability to complete the Massachusetts Police Training Committee Reserve Police Academy, including but not limited to; constitutional law, criminal law, criminal procedure, first aid, CPR, and the use of force, firearms safety, handling and qualification. The ability to operate a motor vehicle; and the possession of a valid Motor Vehicle Operator's License from Massachusetts or another state; The ability to establish rapport with persons from different ethnic, cultural and or economic backgrounds; The ability to use investigative techniques to obtain information in accordance with established procedures, through the examination of records and documents, as well as through interviews and observations. The ability to develop and maintain an in-depth knowledge of state statutes and regulations, as well as to apply and explain said statutes and regulations The ability to analyze and determine the applicability of data, to draw conclusions and to accurately report information and make appropriate recommendations. The ability to write concisely, to express thoughts clearly and to develop ideas in logical sequence; The ability to properly prepare and present a report of alleged violation of law before the Commission or Local Licensing Authorities. The ability to develop and maintain familiarity with administrative law and procedure, as well as to testify, examine and cross-examine witnesses before the Commission. The ability to work independently, as well as in a team, and to adhere to the Investigation and Enforcement Division Policy and Procedure Manual. The ability to exercise discretion in handling confidential information; The ability to maintain a calm manner and a command presence in stressful, volatile or emergency situations, as well as physically defend yourself. The ability to walk, stand or drive a motor vehicle for prolonged period of time and distance, as well as to move or carry up to seventy-five pounds. The ability to proficiently utilize MS Word, Excel, Outlook; WORK ENVIRONMENT u2013 CONDITIONS This position requires working 37.5 hours per week and the flexibility to work alternating shifts that include nights, weekends and holidays. The average work week is comprised of 3 day shifts and 2-night shifts and often includes driving to statewide locations. The position also requires being in bars and liquor stores throughout the commonwealth, where an Investigator will be interacting with persons under the influence of alcoholic beverages and or narcotics; which may result in being in dangerous situations, where an Investigator could be at risk of serious bodily injury or death. Investigators are trained in the use of verbal de-escalation techniques, as well as defensive tactics; including hand control techniques, striking implements and chemical sprays. The position requires that the Investigator be physically and mentally fit enough to safely and effectively employ such techniques should the need arise. EDUCATION AND EXPERIENCE REQUIREMENTS A Bacheloru2019s degree granted by an accredited college or university. OR Two years of investigatory or law enforcement experience, or an equivalent or related field. Physical Requirements: Ability to lift up to 10 lbs.
